The EU requires YouTube and TikTok to provide child protection information by November 30th.

On November 10, 2023, the European Commission officially sent information requests to TikTok and YouTube in accordance with the Digital Services Act (DSA) regulations. The Commission requested both companies to provide additional information explaining the measures they have taken to comply with obligations related to online child protection as stipulated by the DSA. The information required includes measures to assess and mitigate risks related to mental and physical health, as well as risks associated with children using their services.

TikTok and YouTube have until November 30, 2023, to provide the requested information to the European Commission. The European Commission will assess the next steps based on its evaluation of the responses, which may involve initiating formal legal proceedings under Article 66 of the DSA.

According to Article 74(2) of the DSA, the European Commission can impose penalties for inaccurate, incomplete, or misleading information provided in the information requests. If the requests are not responded to, the Commission can pass a decision requiring the information to be provided. In this case, failure to respond by the deadline may result in TikTok and YouTube facing regular fines.

After being designated as super-large online platforms, TikTok and YouTube must fully comply with the DSA regulations, including assessing and mitigating risks related to the transmission of illegal and harmful content, as well as protecting fundamental rights (including children's rights) to prevent any negative impact on minors.

Under this legislation, online platforms are responsible for their content and must take measures to prevent the dissemination of illegal and harmful content. The law also requires platforms to remove such content and establish reporting mechanisms for users to report inappropriate content.
